IGUA Appeals NEB Cost of Capital Decision
November 2, 2009
IGUA and the Canadian Association of Petroleum Producers (CAPP) today filed a joint leave to appeal with the Federal Court of Canada in regard to the NEB’s October 8, 2009 decision to discontinue use of its current formulaic methodology for determining a fair cost of capital for NEB-regulated pipelines.
IGUA appealed the NEB decision because of serious concerns about the inadequate review process used by the NEB to solicit comments from interested parties. The NEB departed from its usual fair and transparent public hearing process and by so doing, failed to provide parties such as IGUA with an opportunity to review and comment on other parties’ submissions.
The Cost of Capital represents a significant component of regulated pipelines’ annual cost structure that is eventually flowed through to the rates that industrials and other Canadians pay for regulated energy utility services. The determination of a fair and adequate cost of capital is an important part of the NEB’s regulatory over sight of regulated pipelines.
